Anti-Bullying

Arkansas Code § 6-18-514 requires all public school districts and open-enrollment charter schools to adopt, implement, and enforce antibullying policies to create safe learning environments for all students.

Policy Requirements
Antibullying policies must:

  • Define bullying in accordance with state law.
  • Prohibit bullying while in school, on school equipment or property, in school vehicles, on school buses, at designated school bus stops, at school-sponsored activities, or at school-sanctioned events.
  • Provide procedures for students, parents, and staff to report incidents of bullying.
  • Describe consequences or disciplinary actions for students who bully others.
  • State protections against retaliation for reporting incidents in good faith.

Procedural Requirements
District antibullying procedures should include:

Investigation Requirements: Outline procedures and specify timelines for addressing complaints.
Prevention Strategies: Include training and education programs for staff and students.
Reporting Methods: Allow for written or oral reports, including options for anonymous reporting.
Timelines: Ensure prompt investigation of suspected bullying, with clearly established deadlines for resolution.
Notification Procedures: Notify parents or guardians of both the alleged victim and alleged offender upon receipt of a report and at the conclusion of the investigation.
Documentation Requirements: Maintain written records of all bullying reports, investigations, and disciplinary actions taken.
Referral Process: Establish clear procedures for referring students to counseling, support services, or alternative interventions when appropriate.
Annual Review: Conduct regular reviews and updates of policies to ensure alignment with state law and DESE rules.

Reporting & Compliance
Public school districts and open-enrollment charter schools must file their antibullying policy with the Arkansas Division of Elementary and Secondary Education (DESE) by posting the policy on the district’s website in accordance with the DESE Rules Governing Website Information Posting Requirements.
